This Refund & Cancellation Policy applies to services purchased from Leave Your Mark Media (“LYMM,” “we,” “us,” or “our”).
This Policy should be read together with the applicable proposal, service agreement, statement of work, invoice, and our Terms & Conditions.
Nothing in this Policy is intended to limit any rights that cannot lawfully be excluded under applicable law.
1. Our ServicesLYMM provides professional marketing strategy, consulting, marketing operations, implementation, content, systems, and related services.
Because these services involve reserving time, professional expertise, planning, research, strategy, implementation, and work performed specifically for a client, payments are
non-refundable once work has commenced, subject to applicable law and the terms of the applicable Client Agreement.
2. Deposits and Initial PaymentsUnless otherwise stated in writing, deposits and initial payments are applied toward the services described in the applicable agreement.
Once LYMM has commenced work, amounts paid for work already performed, time reserved, research completed, strategy developed, materials created, or other services delivered are
non-refundable.
3. Project-Based ServicesFor project-based engagements, cancellation after work has commenced does not automatically entitle the client to a refund.
If a client cancels a project after work has commenced, LYMM may retain or invoice amounts reasonably attributable to:
- work already completed;
- work in progress;
- research and strategy;
- meetings and consultations;
- deliverables created;
- time reserved;
- third-party costs incurred on the client's behalf; and
- other non-recoverable project costs.
Where appropriate, any remaining unearned amount may be refunded or credited at LYMM's discretion, subject to the applicable client agreement and applicable law.
4. Retainers and Recurring ServicesRecurring or retainer services are governed by the cancellation and notice provisions contained in the applicable Client Agreement.
A client may be required to provide written notice before the next billing period in accordance with the applicable agreement.
Once a billing period has commenced, fees for services scheduled, reserved, or performed during that period are
non-refundable, subject to applicable law.
5. Strategy, Audit and Consulting ServicesStrategy, audit, consulting, and roadmap services involve professional time and intellectual work that begins before the final deliverable is provided.
Accordingly, once work has commenced, fees are generally non-refundable.
For example, if LYMM has begun research, analysis, strategy development, preparation, meetings, or development of a roadmap, the associated fees may not be refundable.
6. Client-Requested Changes or DelaysChanges in the client's circumstances, priorities, internal resources, staffing, budget, business direction, availability, or decision-making do not automatically create a right to a refund.
Where a client requests a material change to the agreed scope, LYMM may treat the request as a change order or additional service.
Client-caused delays may also require a project to be rescheduled based on LYMM's availability.
7. Non-PaymentIf a payment is overdue, LYMM may pause or suspend services until the account is brought current.
Suspension of services due to non-payment does not waive amounts already due.
LYMM may terminate an engagement for material non-payment where permitted by the applicable agreement.
8. Third-Party CostsThird-party expenses, advertising spend, software subscriptions, platform fees, domain registrations, hosting fees, contractors, transaction fees, or other external costs paid or incurred on behalf of a client are generally non-refundable unless the applicable third-party provider issues a refund.
9. No Refund Based Solely on ResultsA client is not entitled to a refund solely because the client did not achieve a particular marketing, sales, revenue, audience, advertising, engagement, or business result.
Marketing outcomes depend on numerous factors outside LYMM's control.
10. Statutory RightsNothing in this Policy limits, excludes, or waives any cancellation, refund, consumer-protection, or other rights that apply under mandatory provisions of applicable law.
Where applicable law provides a consumer with a statutory right to cancel a contract or receive a refund, that right will apply regardless of any conflicting provision in this Policy.
